Role of the Attending Officer

An attending officer is appointed under Queen’s Regulations and Orders for the Canadian Forces (QR&O) 19.57 when a CF member is charged in a civil criminal court. An attending officer is a representative of the CF and attends the court on behalf of the Commanding Officer. An attending officer is not appointed to assist or speak for an accused in civil court. Prior to the trial of an officer or non-commissioned member before a civil court, the attending officer shall: obtain a statement of the member’s record of service, pay account and service conduct generally; and ascertain whether the commanding officer authorizes the attending officer, in accordance with article 19.58 (Payment of Fines and Costs), to pay any fine imposed.

Prior to the trial of an officer or non-commissioned member before a civil court, the attending officer shall inform the member that the attending officer’s duties do not include acting in any way as the memb er’s solicitor, counsel or advocate.

In accordance with article 19.60 (Duties of Attending Officer prior to trial) an attending officer shall, if requested by the court, give the court: all information in the attending officer’s possession as to the service conduct generally of the accused; and full particulars of any previous conviction of the accused of an offence under section 130 of the National Defence Act.

No attending officer shall : give particulars of any previous convictions of the member other than those specified in subparagraph (1)(b); produce the conduct sheet of the member; or act in any way as the member’s solicitor, counsel or advocate.
